Wow! Bet Jeffrey Fieger will be working with those fired employees for wrongful termination.....could cost more than the health care costs the company was trying to avoid...

I think it might be legal. There are companies that say in their ads that they won't hire anyone who smokes. I think it is legal for a private company to have the kind of employees they want to have to represent them.

But we shall see.

Yes, as they are a privately owned company, it is and was legal. They're security net was their disclaimer to the employees in 2003 that the policy was going into effect in 2005. However....being legal also means...having loopholes. I'm sure someone will get wealthier.
